The sentence si presenta a doppia velocita': da una parte condanna tutti i poliziotti di cui e' stato possibile dimostrare l'entrata nella scuola Diaz (ovvero i 13 appartenenti al VII nucleo sperimentale della I squadra mobile di Roma) , sebbene non vi sia prova che ognuno abbia materialmente compiuto le violenze sugli occupanti la scuola in base al seguente ragionamento.
" Gli imputati pertanto, che, entrati nell’edificio durante il periodo in cui le violenze vennero poste in essere, ebbero la possibilità di rendersi conto di quanto stava accadendo, vanno ritenuti responsabili in concorso tra loro del reato di lesioni in danno di tutte le vittime di tali violenze, senza alcuna distinzione tra i fatti cui avevano assistito direttamente e quelli avvenuti in altre parti della scuola , dato che sia l’accordo di cui si è detto sia il loro comportamento omissivo valsero certamente a rinforzare il proposito criminoso e ad agevolare il comportamento violento di tutti coloro che operavano all’interno della Diaz.
Non appare infine superfluo osservare che quanto sin qui esposto rende di scarso rilievo accertare se le violenze siano state poste in essere esclusivamente o principalmente dagli appartenenti al VII Nucleo ovvero ad altri reparti."
